A property can present beautifully and still be difficult to transfer, difficult to mortgage, or difficult to insure. The condition you can see is only half of what a buyer is purchasing.

What the documents have to agree on

The deed, the survey plan and the physical property have to describe the same thing. Where they do not, the difference has to be explained before a value can be relied upon.

  • Extent on the deed against extent on the survey plan
  • Boundaries as surveyed against boundaries as built
  • Approved plans against what is actually standing
  • Rights of way and access recorded against access used in practice

Why it is worth checking early

Most of these can be resolved. Almost none can be resolved quickly. Finding them at the start of a transaction is inconvenient; finding them at the end is expensive.
